Terms of Service

These Terms of Service ("Terms") govern your use of the GoodWork platform, mobile application, and website (the "Platform"), operated by GoodWork Innovations LLC ("GoodWork," "we," "us," or "our").

By accessing or using the Platform, you agree to these Terms.

1. Eligibility

  • You must be at least 18 years old to use the Platform.
  • Artists are responsible for verifying client age at appointments. GoodWork does not independently verify age.

2. Platform Description

  • GoodWork is a marketplace platform that connects clients with independent tattoo artists.
  • GoodWork does not provide tattoo services and does not employ artists.
  • Artists are independent contractors responsible for their own services, pricing, licensing, and compliance with applicable laws.

3. Accounts

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity under your account

We may suspend or terminate accounts for violations, misuse, or fraud.

4. Bookings & Payments

4.1 Subscription

GoodWork is free for artists to use. There is no subscription fee, monthly fee, or sign-up cost for artists.

4.2 Fee Structure

Artists set their own service prices. Displayed prices may be estimates. GoodWork charges fees based on how the booking originates:

  • Platform-Sourced Bookings: When a new client discovers and books an artist through the GoodWork discovery feed (no referral code), a one-time 20% platform fee applies to the deposit. This fee is paid by the artist and deducted before payout. This fee applies only to the first booking with that client.
  • Referral Link Bookings: When a client books through an artist's personal booking link (contains a referral code), a 6% service fee is added to the client's total. The artist receives their full quoted price with no platform fee deducted.
  • Repeat Bookings: When an existing client books again with the same artist, a 6% service fee is added to the client's total. The artist receives their full quoted price with no platform fee deducted.

All applicable fees are clearly disclosed before booking confirmation.

4.3 How Booking Origin Is Determined

  • If a booking URL contains a referral code (e.g., the artist's personal booking link), it is treated as a referral booking.
  • If the client has previously booked with the same artist, it is treated as a repeat booking.
  • If neither condition applies (new client, no referral code), it is treated as a platform-sourced booking.

4.4 Deposits

  • Deposits are required to secure bookings. Deposit amounts are set by each artist.
  • Artists may choose a fixed deposit amount or a percentage of the estimated service price.
  • Deposits are collected through Stripe at the time of booking and held until the service is completed or cancelled.
  • Upon service completion, the deposit (minus any applicable fees) is released to the artist's connected Stripe account.

4.5 Payment Processing

  • All payments are processed securely through Stripe. GoodWork does not store full payment card details.
  • Artists must connect a Stripe account to receive payouts. Stripe may require identity verification.
  • Artist payouts are processed daily to their connected bank account via Stripe. Funds typically arrive within 2 business days.

5. Cancellations, Refunds & No-Shows

5.1 Client Cancellations

If a client cancels a confirmed booking, the deposit is non-refundable. The artist keeps the deposit as compensation for the reserved time.

5.2 Artist Cancellations

If an artist cancels a confirmed booking, the client receives a full deposit refund. Refunds are processed through Stripe and typically arrive within 5-10 business days.

5.3 No-Shows

If a client fails to show up for a confirmed appointment without prior notice, the deposit is forfeited. The artist keeps the full deposit.

5.4 Exceptions

Refund exceptions (such as emergencies or documented extenuating circumstances) may be reviewed on a case-by-case basis but are not guaranteed. Both parties should communicate promptly if issues arise.

6. Artist Responsibilities

Artists agree to:

  • Provide accurate profile and pricing information
  • Maintain required licenses and permits
  • Follow all health and safety regulations
  • Verify client age (18+)
  • Honor confirmed bookings

7. Client Responsibilities

Clients agree to:

  • Provide accurate booking information
  • Arrive on time
  • Be at least 18 years old
  • Treat artists professionally

8. Disclaimers & Limitation of Liability

  • GoodWork does not endorse or guarantee artist services.
  • Artists are solely responsible for:
    • Tattoo quality
    • Health and safety practices
    • Licensing and compliance
  • To the maximum extent permitted by law, GoodWork is not liable for indirect, incidental, or consequential damages.
  • GoodWork's total liability shall not exceed the fees paid to GoodWork in the six months preceding the claim.

9. Intellectual Property

  • Artists retain ownership of their content but grant GoodWork a non-exclusive, royalty-free license to display and promote it.
  • Users grant GoodWork a similar license for any content they upload.

10. Prohibited Conduct

You may not:

  • Use the Platform unlawfully
  • Harass or abuse others
  • Upload false or misleading content
  • Circumvent Platform payments
  • Attempt unauthorized access
  • Use bots or scraping tools

11. Dispute Resolution

11.1 Disputes Between Clients and Artists

GoodWork is a marketplace that connects clients with independent artists. We are not a party to the tattoo service itself. Disputes about tattoo quality, design, pricing beyond the deposit, or the service experience are between the client and artist.

  • We encourage clients and artists to communicate directly to resolve issues.
  • If you need help, contact us at [email protected]. We may assist with communication or provide information, but we cannot guarantee resolution or serve as an arbitrator between parties.
  • Artists are solely responsible for the services they provide. GoodWork does not guarantee or endorse artist work.

11.2 Disputes with GoodWork

For disputes directly involving GoodWork (such as billing issues, account access, or Platform functionality):

  • Informal Resolution: Please contact us first at [email protected]. We'll work to resolve issues quickly.
  • Arbitration: If we can't resolve the dispute informally, it will be settled through binding arbitration in Los Angeles County, California.
  • You may opt out of arbitration by notifying us in writing within 30 days of account creation.
  • Class action lawsuits are waived.

12. Governing Law

These Terms are governed by the laws of the State of California.

13. Changes to Terms and Fees

  • We may update these Terms, including fee structures, at any time.
  • For material changes (such as fee increases), we will provide at least 30 days' notice via email or in-app notification before the changes take effect.
  • Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
  • If you do not agree to the changes, you may close your account before they take effect.

14. SMS Communications

By providing your phone number and enabling SMS notifications on GoodWork, you consent to receive text messages from us.

14.1 Types of Messages

We may send SMS messages for:

  • Booking confirmations and updates
  • Appointment reminders (24 hours and 2 hours before)
  • Payment confirmations
  • New booking requests (for artists)
  • Important account and service updates

14.2 Consent

  • SMS notifications are optional. You must explicitly opt in to receive text messages through your account settings.
  • By enabling SMS notifications, you confirm that you are the owner or authorized user of the phone number provided.
  • Your consent to receive SMS is not required to use GoodWork or make purchases.

14.3 Message Frequency

Message frequency varies based on your booking activity. You may receive multiple messages per week if you have active bookings.

14.4 Opt-Out

  • You can opt out at any time by replying STOP to any message.
  • You can also disable SMS notifications in your Account Settings.
  • After opting out, you will receive a confirmation message and no further SMS messages unless you re-enable notifications.

14.5 Costs

Message and data rates may apply. GoodWork does not charge for SMS messages, but your carrier's standard messaging rates apply.
